Workshop Title: Power Imbalances in Mediation
Workshop Description (according to the workshop provider)
Power Imbalances are ever-present in mediations. Some power imbalances may be less obvious to the mediator than others, or pose less of an issue at the table. There are times when the power imbalance is the 300 pound gorilla in the room. Is it the mediator’s job to compensate for the imbalance? If no, then will the mediation process still be effective? If yes, what techniques work best in a given situation? When a mediator injects himself/herself into the mediation, in what way is the facilitative process altered? What are the ethics involved in making such interventions?
This workshop is intended to aid mediators in making such judgment calls, and to help them determine their own comfort level if and when they intervene. Various degrees and approaches of intervention will be discussed, along with their respective merits

Appellate Mediation Program
The Appellate Mediation Program is an initiative of the Supreme Court bench and is administered by the Office of Alternative Dispute Resolution.
Exploring mediation and other innovative methods of alternative dispute resolution have become hallmarks of Chief Justice Williams’ tenure as he encourages litigants to resolve disputes without the expense and time of trials.
Most civil cases that have been directly appealed from final judgment are eligible for mediation through the program. There are presently five retired judges who serve as mediators at no cost to the state.
